Welcome to JustListed.Social (“Just Listed.social”), the elite web service enabling real estate professionals to market themselves, their companies, and their services via targeted Facebook advertising. JustListed.Social is owned, operated, and powered by the social media marketing company known as SocialMadeSimple, (“Social Made Simple”).

Hereinafter, SocialMadeSimple together with its affiliates, successors, and assigns, including but not limited to JustListed.Social will collectively be referred to as “our,” “we,” “us,” or “SocialMadeSimple”. The scope of this Terms of Service & Privacy Policy includes, but is not limited to the collection of personal identifying information, otherwise known as “PII”, as well as any other information that may not personally identify an individual, the limitations of liability and responsibility of SocialMadeSimple, Third Party policies, Ad Transparency, and an in-depth user agreement, which may be modified periodically as needed. It is recommended for users to periodically review this Terms of Service & Privacy Policy, to ensure no changes have been overlooked.


Ad Disclosure & Transparency

In compliance with the Facebook Privacy Policy, section 14, regarding the Marketing API, SocialMadeSimple is hereby disclosing the fixed fee and variable percentage of ad spend for services granted, purchased, or otherwise obtained by Users of the JustListed.Social product. 

Just Listed, Just Sold, Open House, and/or Price Change ads will be hereinafter referred to as “Just Listed” Campaigns. This Ad Disclosure & Transparency clause does not apply to our Farming Ads. For Just Listed ads, SocialMadeSimple allocates $8 per day in Facebook ad budget per individual ad campaign. The price and ad spend allocation for our Farming Ads are displayed directly on the webpage where they are available for purchase. 


SocialMadeSimple Platform Use

For each JustListed.Social purchase, customers are granted a trial account for SocialMadeSimple's social marketing platform. The following pertains to such use:

SocialMadeSimple hereby; 

  • reserves the absolute right to withhold, remove, and or discard any content available as part of your account, with or without notice, 

  • assumes no liability or responsibility for an individual’s interactions on SocialMadeSimple, and reserves the right, but is not obligated, to monitor materials on SocialMadeSimple and to terminate any account if we determine, in our sole discretion that doing so is advisable, 

  • exercises no control or responsibility over any content you or others submit under your SocialMadeSimple account while using services provided by SocialMadeSimple,

  • is not bound by any obligation to verify the identity of any Users when he or she is connected to our site,

  • Explicitly denies any responsibility for any content provided by users or others including Third Party Sites (as defined below),

  • Is not liable for any misuse or misappropriation of any material, content, or in information posted on SocialMadeSimple. 

SocialMadeSimple may include or automatically produce links to third party websites (“Third Party Sites”). SocialMadeSimple reserves the right to include articles, photographs, texts, graphics, pictures, designs, music, sound, video, information, applications, software, or any other content or items belonging to or originating from Third Party Sites and is not responsible for the accuracy or completeness of content or other materials on or available from said Third Party Sites. By clicking below and/or by accessing, viewing, downloading, joining, participating, or otherwise using in any manner SocialMadeSimple or any webpage or feature associated with SocialMadeSimple, or available through, by, or in conjunction with SocialMadeSimple, you are hereby: 

  1. Entering a legally binding agreement with SocialMadeSimple, LLC,

  2. Acknowledging that you have read, understand, and agree to the terms and conditions of this User Agreement (the “User Agreement”) and the SocialMadeSimple Privacy policy (“The Privacy Policy”) as the same may be modified, altered, or amended from time to time,

  3. Subject to all applicable laws, rules, and regulations,

  4. Not under the age of 18,

  5. Not a direct competitor of SocialMadeSimple

  6. Not violating any other agreement to which you are legally bound by or are currently a party of, and have the full autonomous power and authority to enter into this User Agreement,

  7. Indemnifying and holding harmless SocialMadeSimple and its officers, directors, principals, members, managers, employees, or any other associate from any damages, losses, and costs (including, but not limited to reasonable attorneys’ fees) related to tird party claims, charges or investigations, caused by:

    1. Your failure to comply with this User Agreement, including but not limited to your submission of content that violates third party rights or applicable laws,

    2. Any content you submit to SocialMadeSimple or

    3. Any activity whatsoever in which you engage in or through SocialMadeSimple and or our services.

If you are using SocialMadeSimple on behalf of a legal entity, this User Agreement shall apply and bind both such entity as well as you individually. By submitting anything to SocialMadeSimple (including any User generated content, ideas, concepts, techniques, information and/or data), you and/or any entity you are associated with hereby agrees to the following:

  • granting a non-exclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sublicensable, fully paid and royalty free right to us to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, and use and commercialize, in any way known or in the future discovered, anything that you submit to us, without any further consent, notice and/or compensation to you or to any third parties.

  • You represent and warrant that such submission is accurate, non-confidential, and is not in violation of any contractual restriction or other third party rights. You further agree to inform SocialMadeSimple in the event that any such information has changed since your registration with SocialMadeSimple and, if appropriate, you agree to make such modifications yourself to your profile, platform, or any other association with SocialMadeSimple. 

  • You are responsible for anything that happens through your account. Your password should be absolutely confidential. Do not use other Users’ accounts, and do not allow other users to use your account.

  • You are prohibited from selling, trading, or otherwise transferring your SocialMadeSimple account or any information therein to another party or charging any other individual or party for access to any features, portions, or property of SocialMadeSimple.


In the event you elect to terminate your membership with any product associated with SocialMadeSimple, upon our receipt of your notice of termination, you will no longer receive any additional billings from SocialMadeSimple, however, you will continue to have access to the Website throughout the remainder of the paid term of your membership. Each User grants SocialMadeSimple a license to use the content supplied by each User, which includes, inter alia, the right for SocialMadeSimple to reproduce, represent, adapt, translate, digitize, use for advertising purposes, whether commercial or non-commercial, to sublicense or to transfer the content concerning each User (including information, pictures, descriptions, search criteria, etc.). Each User expressly authorizes SocialMadeSimple to modify said content in order to conform to the interface or display requirements of the Services or of other communications media as set forth above, and/or to render them compatible with its technical performance or media format in question. These rights are granted throughout the world and for the entire term of this Agreement. The User is prohibited from copying, reproducing or otherwise using the content relating to other Users of SocialMadeSimple for any purpose other than for those purposes strictly related to use of SocialMadeSimple services for personal purposes. If you are a copyright owner or an agent thereof ("Owner") and believe that any content, information or data (the "Accused Content") infringes upon your copyrights, you may submit a notification (a "Takedown Notice") pursuant to the Digital Millennium Copyright Act ("DMCA") by providing us with the following information in writing :

  • A physical or electronic signature of a person authorized to act on behalf of the Owner of an exclusive right that is allegedly infringed; 

  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

  • Identification of the Accused Content that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit SocialMadeSimple to locate the Accused Content; 

  • Information reasonably sufficient to permit SocialMadeSimple to contact the owner, such as an address, telephone number, and, if available, an electronic mail address; 

  • A statement that the Owner has a good faith belief that use the Accused Content in the manner complained of is not authorized by the Owner, its agent, or the law; and 

  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. You acknowledge that if you fail to comply with all of the requirements of the DMCA, your DMCA notice may not be valid. 

SocialMadeSimple may share the Takedown Notice with the Provider of the Accused Content or any other person, and SocialMadeSimple may publish the Takedown Notice. SocialMadeSimple will only take down Accused Content of which it is made aware in accordance with the DMCA on the Website; SocialMadeSimple is not responsible for taking down any Accused Content on any third party website. SocialMadeSimple has the option, but not the obligation, to notify any third party website that the Accused Content is subject to a Takedown Notice. The provider of the Accused Content (the “Provider”) may make a counter notification pursuant to Sections 512(g)(2)and (3) of the DMCA (the “Counter Notice”). When SocialMadeSimple receives a Counter Notice, we may (but we have no obligation to) reinstate the Accused Content. To file a Counter Notice with us, the Provider must provide a written communication that sets forth the items specified below. Please note that you may be liable for damages (including costs and attorney’s fees) if you materially misrepresent that a product or activity is not infringing the copyright of others. To expedite our ability to process your Counter Notice please use the following format (or any other that complies with the provisions of the DMCA): 

  • Identify the specific URLs of the Accused Content on other material that SocialMadeSimple has removed or to which SocialMadeSimple has disabled access.

  • Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, and that  you will accept service of process from the Owner or the person who provided the Takedown Notice or an agent of such person. 

  • Include a statement, under penalty of perjury, that you have a good faith belief that the Accused Content was removed or disabled as a result of a mistake or misidentification of the Accused Content.

  • Sign the paper or other communication.

We suggest that you consult your legal advisor before filing a Takedown Notice or a Counter Notice. Additionally, please be aware that there are penalties for false claims under the DMCA. SocialMadeSimple reserves the right to share or publish any Takedown Notice or Counter Notice at any time. If a Counter Notice is received by the Copyright Agent, SocialMadeSimple may send a copy of the Counter Notice to the Owner or original complaining party that filed the Takedown Notice informing the Owner tat SocialMadeSimple may reinstate the Accused Content or cease disabling it in 10 business days. Unless the Owner files an action seeking a court order against the Provider of the Accused Content, the Accused Content may be reinstated, or access to it restored, at SocialMadeSimple’s sole discretion. YOU AGREE THAT YOUR USE OF THE WEBSITE AND SERVICES SHALL BE AT YOUR OWN RISK AND THAT ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND "WITH ALL FAULTS." TO THE FULLEST EXTENT PERMITTED BY LAW, SOCIALMADESIMPLE, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, LICENSORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN CONNECTION WITH THE SERVICES, SOCIALMADESIMPLE MAKES NO GUARANTEES OR WARRANTIES THAT ALL USER CONTENT WILL BE POSTED TO IDENTIFIED THIRD PARTY SITES AND SOCIALMADESIMPLE UNDERTAKES NO OBLIGATIONS TO REGISTER USERS WITH OR PAY USERS' DUES TO ANY THIRD PARTY WEBSITES. The Agreement shall be governed by the internal substantive laws of the Commonwealth of Massachusetts, without respect to its conflict of laws principles. The User Agreement, and any other legal notices published by SocialMadeSimple on the Website, shall constitute the entire agreement between you and SocialMadeSimple. If any provision of the User Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provisions shall not affect the validity of the remaining provisions of the User Agreement, which shall remain in full force and effect. No waiver of any term of the User Agreement shall be deemed a further or continuing waiver of such terms or any other term, and any failure to assert any right or provision under the User Agreement shall not constitute a waiver of such right or provision. SocialMadeSimple reserves the right to amend the User Agreement at any time and without notice, and it is your responsibility to review the User Agreement for any changes. Your use of the SocialMadeSimple Website following any amendment of this User Agreement will signify your assent to and acceptance of its revised terms on a prospective basis. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SOCIALMADESIMPLE WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.
